Regulation (EU) 2024/1028 on data collection and sharing relating to short-term accommodation rental services and amending Regulation (EU) 2018/1724 establishes a European data-sharing framework containing detailed information on the hosts and accommodation involved and the number of nights their guests stay. Though its creation was justified on statistical and monitoring grounds, such a system could, in practice, pave the way for the imposition of substantial limits on the use of private real estate, undermine Regulation (EU) 2016/679’s data protection provisions and curtail the right to conduct a business and to own property enshrined respectively in Articles 16 and 17 of the EU Charter of Fundamental Rights.

Though the Union has no explicit competence for housing and urban planning policy (see Article 5 TEU), the Commission has announced that, by the end of the year, it will propose binding measures concerning short-term rentals – including caps on the annual number of nights that property can be rented and restrictions in areas under ‘housing stress’ – as part of its European Affordable Housing Plan.

In the light of the above:

  • 1.Having regard for the principles of subsidiarity and proportionality enshrined in Article 5 TEU, what is the legal basis for the restrictions the Commission is planning to introduce?
  • 2.What empirical evidence is there that clearly proves that the growth of short-term rentals is indeed causing the housing crisis by reducing the number of available dwellings?
  • 3.How will the Commission prevent its measures from having a disproportionate effect on small property owners?
